Viscar.pl Wholesale Purchase Terms and Conditions

These terms and conditions apply to all business entities making purchases for the purposes of their business activity.

  1. The provisions on consumer protection contained in the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product do not apply to the following agreement
  2. The owner of the VISCAR.PL online store is INTERSPIN, Łukasz Kołodziej, with its registered office in Warszawa at Al. Wilanowska 87/17. NIP 587-142-47-86 REGON 142994045, registered in the business activity register under no. 532099 by the Board of the Mokotów District of the Capital City of Warszawa
  3. The Viscar.pl customer service office is located in Warszawa at Konduktorska 4 and is open Monday to Friday from 9-17
    The Viscar.pl store sells by mail order within Poland and abroad. Orders are accepted around the clock via the internet through the website www.viscar.pl, or - for customers who have their own account in the store system – by e-mail, or by phone with confirmation sent by fax.
    Orders placed through the viscar.pl website outside the Viscar.pl customer service office's opening hours will be checked for correctness on the next business day.
  4. To process an order, registration in the Viscar.pl store system is required. After placing an order, the buyer will receive an e-mail confirming that the order has been accepted for processing and requesting confirmation of the order. Failure to confirm the order within 24 hours will result in cancellation of the order.
  5. Order processing begins when:
    1. the order is placed - for orders with the cash-on-delivery option
    2. a transfer from the buyer in the amount agreed when placing the order is received – for orders paid by bank transfer
    3. the payment transaction for the order is authorized – when payment by credit card or through an electronic payment system is selected
    Once order processing has begun, the order cannot be changed or canceled.
  6. The Viscar.pl store sells goods from its own warehouses and on a made-to-order basis. If goods are unavailable in the store's warehouse and from the store's suppliers, the buyer will be informed. The buyer may then cancel the entire order, cancel part of the order, or wait for the entire order to be fulfilled.
  7. Orders are delivered by UPS to the address indicated during checkout.
    The shipping cost is borne by the buyer unless the parties decide otherwise under individual arrangements. Courier shipping prices depend on the weight of the shipment, destination country and payment method. The shipping cost is specified each time during checkout and under the "delivery" tab; shipping costs can also be found in the store's FAQ section.
    Relations concerning receipt of the shipment are governed by the agreement between UPS Polska Sp. z o.o. and Interspin dated 07 July 2011. A copy of the above agreement may be shown to any registered customer upon request.

  8. Acceptance of an order for processing by viscar.pl is confirmed each time by an appropriate notification that requires acceptance by the buyer. Failure to receive notification that the order has been accepted for processing, or failure to confirm the order, results in cancellation of the entire order.
  9. When ordering goods from the special-order range or goods cut to order, a deposit of 30% of the value of the ordered goods must be paid into the viscar.pl account. If the buyer withdraws from the purchase, viscar is not required to refund the deposit unless the parties agree otherwise.
  10. Viscar.pl will inform the buyer if goods are unavailable or if there is another reason why the goods cannot be delivered to the buyer. In such a case, the buyer has the right to withdraw from the agreement without incurring costs or to declare willingness to wait for the goods for longer than the period specified in the order.
  11. The time required for the buyer to receive the shipment with the order consists of the time needed to prepare the shipment and deliver it. The estimated delivery time for an order is 2 business days. Orders will be processed as quickly as possible; however, the standard order processing time is 2 business days.
    The above periods do not apply to goods sold with the "made to order" option. In this case, the processing time is agreed individually with the customer
  12. The buyer may also collect the order in person from the Viscar.pl customer service office at the store's premises. Personal collection takes place after arranging the collection date each time and is free of charge.
  13. Proof of purchase is the VAT invoice enclosed with each shipment. VAT invoices are issued after all required fields in the order form have been completed.
  14. The buyer is entitled to warranty repairs for goods covered by warranty. Warranty repairs apply to defects in goods arising during normal use.
    The warranty terms are specified in each case in the warranty card enclosed with the goods covered by the warranty service.
    Warranty repairs are carried out after the complaint is accepted, within 21 days of delivery of the damaged goods to the viscar customer service office. Warranty repairs are carried out at the expense of the equipment manufacturers and/or the Viscar.pl store.
  15. Every item sent to the customer is quality-checked, carefully protected and packed so that it reaches the buyer undamaged. If damage to the packaging and contents of the shipment is found upon receipt, the relevant information must be entered on the waybill and a damage report must be prepared in the courier's presence. In the above situation, the buyer should consult the Viscar.pl Store Customer Service Office regarding further action. Claims for transport damage to shipments accepted without reservations do not have to be recognized by the viscar.pl store
  16. The buyer has the right to return goods that do not conform to the agreement. The buyer is required to notify the store immediately of the non-conformity of the goods with the agreement, attaching the appropriate form available in the FAQ section of the viscar.pl store. The Viscar.pl store will consider all complaints within 14 business days from receipt of the notification and the damaged/non-conforming goods. Complaints do not cover mechanical damage or damage caused by improper use of the goods. If non-conformity of the goods with the agreement is recognized, the Viscar.pl store is required to repair or replace the goods. If this is not possible, the buyer will receive a refund of the amount paid for the goods.
  17. Complaints should be submitted to the viscar.pl customer service office in writing in advance. After the terms of the complaint procedure have been agreed, the goods should be delivered at the buyer's expense to the viscar.pl customer service office in their original, properly protected packaging. If the complaint is accepted, the buyer is entitled to reimbursement of the above-mentioned transport costs. If the complaint is rejected, the buyer may collect the complained-about goods in person from the viscar customer service office, or the goods will be sent at the buyer's expense. If the buyer discovers defects in the product, the buyer should immediately notify the viscar.pl customer service office and stop using the defective product. The defective product should be packed in its original packaging and stored until inspection by a specialist authorized by the viscar.pl staff. If a complaint concerning a defect relates to film or consumer chemical products, using more than 10% of the quantity of the complained-about goods makes the complaint unjustified.
  18. The viscar store does not accept returns of goods from business entities, in particular goods showing signs of use, unless the parties agree otherwise under individual arrangements.
  19. Professional application of films and use of chemical preparations should be supported by appropriate skills and experience. Correct application can be guaranteed only by installers authorized by the manufacturers. Viscar.pl's liability is limited to replacement of the defective product. The Viscar.pl store is not liable to business entities for damage caused by those entities to third parties, nor is it liable for indirect losses such as, among others, loss of revenue, customers or expected profits.
  20. Address details provided in the order form in the viscar.pl store are processed and stored in accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002 No. 101 item 926, as amended). The data is used solely for order processing and will not be disclosed to third parties.
    Only with the buyer's consent will the buyer's data be processed for the purpose of providing information about new products and offers from the viscar.pl store
    The buyer has the right to access, modify and delete their personal data.
  21. All prices on the Viscar.pl store pages are expressed in Polish zloty and include VAT.
  22. The names of manufacturers and brands presented on viscar.pl belong to their respective owners.
  23. Photos published in the store are the property of: Hexis, Rtape, Stahls, Interspin and are protected by copyright.
  24. The store layout and logo are protected by the copyrights of Interspin and DIH
  25. Copying all or part of the Viscar.pl website is prohibited
  26. Photos of film applications published in the viscar.pl store are examples of use; the viscar.pl store does not guarantee identical results when applying self-adhesive films. Reproduction images of products may differ slightly from reality due to different personal settings and calibration of store users' monitors.
  27. The buyer is required to familiarize themselves with these terms and conditions; by making a purchase, the buyer accepts the terms and conditions and is bound by their provisions.

Important information about GDPR, edition dated 24/08/2018

In connection with the change in personal data protection regulations and the entry into force of the so-called GDPR on 25 May 2018, we inform you that Interspin processes your personal data in connection with purchases made by you (hereinafter: the "Agreement"). The data processed includes:

  • registered business name, NIP and REGON number of the entrepreneur
  • address and delivery address for orders
  • telephone number and e-mail address of the order recipient

The controller of personal data is: Łukasz Kołodziej, owner of Interspin Łukasz Kołodziej with its registered office in Warszawa, (hereinafter: the "Controller").

The Controller informs you that:

  1. Your personal data is processed for purposes related to performance of the Agreement and for purposes arising from the legitimate interests pursued by the Controller;
  2. the data provided is processed pursuant to art. 6 sec. 1 lit. a), lit. b) and lit. f) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);
  3. personal data will be stored for the period specified by law, until the limitation period for the tax liability expires, and in the case of the Controller's legally justified purposes for the duration of their implementation, and on the basis of your consent – until that consent is withdrawn;
  4. you have the right to request that the Controller rectify, erase or restrict the processing of personal data.
  5. you have the right to "be forgotten"; in that case, personal data, except for the registration data of the company for which financial documents were previously issued, will be deleted.
  6. you have the right to lodge a complaint with GIODO (and from the date the new authority is established, with the President of the Personal Data Protection Office) if you believe that the processing of your personal data violates the law;
  7. the personal data originates from the person to whom the data relates;
  8. providing the data is voluntary but necessary to perform the Agreement; failure to provide personal data makes performance of the Agreement impossible;
  9. your data may be processed in the form of analytical profiling in order to tailor the services and offer addressed by the Controller to your needs and to take measurements that will allow the Controller to improve the services it provides; Binding decisions are not automated.
  10. We also inform you that under the accounting services agreement and the personal data processing agreement concluded between Interspin and Kancelaria Doradcy Podatkowego Robert Adam Okulski, your data: company name, NIP number and address, is processed on behalf of the Controller by Kancelaria Doradcy Podatkowego Robert Adam Okulski. The data is processed solely within the scope required to perform the accounting services agreement.
