I. GENERAL PROVISIONS
- These Terms and Conditions define the type and scope of services provided by Interspin operating under the Viscar brand, with its sales office in Warszawa at Konduktorska 4 lok 017 00-775 Warszawa, the conditions for providing those services, as well as the general terms of sale, the conditions for concluding and terminating agreements, and the complaints procedure in connection with purchases made for the purposes of the customer's business activity.
- These Terms and Conditions are available free of charge, including via the Website, in a way that enables the customer to obtain, reproduce and record the content of the Terms and Conditions using the IT system used by the customer.
- The Terms and Conditions constitute a standard form of a distance agreement. When using the services specified in the Terms and Conditions, their content forms part of the agreement concluded between the parties.
- When using the services, the customer is prohibited from providing unlawful content.
- Before using the services, the customer is required to read the Terms and Conditions and accept their provisions.
- A customer may only be a professional entity making purchases for the purposes of its business activity, registered in the Central Register and Information on Business Activity or in the National Court Register, or in the relevant registers within the European Union.
II. PLACING ORDERS IN THE STORE AND SHIPPING ORDERS
- Prices stated in the Store are expressed in Polish zloty (PLN) and are net prices.
- Viscar issues VAT invoices.
- Viscar undertakes to deliver products free from physical and legal defects.
- The Customer is required to use Products offered by Viscar in a manner compliant with the regulations applicable in the territory of the Republic of Poland and in accordance with the provisions of the Terms and Conditions.
- Information about delivery costs is provided when the order details are determined and depends on the type and quantity of products and the choice of carrier that is to deliver the product to the buyer.
- By placing an order with Viscar, the Customer undertakes to pay for the products ordered.
- Viscar delivers goods through UPS, DHL and Sash Express courier companies. Shipping is carried out on behalf of the buyer. The buyer grants the seller power of attorney to conclude an agreement with the courier company on the buyer's behalf.
- When receiving the delivered shipment, the Customer is required to check its technical and physical condition. If the shipment is damaged, it is recommended that a damage report be drawn up in the courier's presence and that Viscar be notified. The damage report is helpful in carrying out the complaints procedure, and its absence may make it more difficult for the customer to pursue possible claims and determine the person responsible for the damage. Complaints concerning damage occurring during shipment submitted by a customer who is not a consumer will not be considered without an attached damage report.
- Processing an order that includes physical products consists of picking the ordered products (if they are available in the store) or producing them in accordance with the order placed (and within the time agreed between Viscar and the customer), then packing them for delivery to the customer and dispatching the shipment to the Customer in accordance with the delivery method selected by the Customer.
- An order is deemed completed when the shipment is dispatched to the customer (when the shipment is entrusted to the carrier engaged in transportation).
- Order processing time depends on the product and is agreed individually with the customer. Ordered products should be released to the customer within 7 days, unless Viscar has expressly indicated a longer period in the product description. In such a situation, by placing the order the customer agrees to the longer processing time resulting from the product description.
- If the customer has ordered products with different indicated processing times, the binding processing time for the entire order is the longest of the times applicable to all products included in the order; however, the seller may propose splitting the order into several separate shipments in order to accelerate processing for some of the products.
- Products may be ordered only through the Viscar.pl webshop system. In exceptional situations, the customer may place an order by phone; however, such an order is subject to an additional handling fee of 25 zł net per order.
III. RIGHT OF WITHDRAWAL
- A Customer who is not a consumer within the meaning of art. 221 of the Civil Code, or a natural person concluding an agreement directly related to their business activity where the content of that agreement indicates that it is of a professional nature for that person, resulting in particular from the subject matter of the business activity performed by that person and made available under the provisions on the Central Register and Information on Business Activity, is not entitled to withdraw from a sales agreement or service reservation agreement within 14 days
- The right to withdraw from a distance agreement also does not apply to a customer in relation to products created and prepared to the customer's special order, for example to dimensions provided by the customer, or in relation to a service agreement where Viscar has fully performed the service with the Customer's express consent after the Customer was informed before performance began that once Viscar had fully performed the service, the Customer would lose the right to withdraw from the agreement.
IV. COMPLAINTS
- The Customer has the right to submit a complaint concerning a product.
- A Customer who placed an order during a telephone conversation is not entitled to make a complaint concerning the goods unless, after receiving a summary of the order placed by phone, sent to the e-mail address provided during the telephone conversation, the Customer immediately confirms in reply to that e-mail that the order recorded by Viscar corresponds to the order placed by the Customer by phone. The order will not be processed unless Viscar receives such confirmation.
- The Customer may submit a complaint to Viscar using the following communication channels:
- by e-mail;
- in writing.
- A complaint should contain at least the customer's first name, surname and e-mail or correspondence address to which Viscar is to send its response to the complaint, the company name in the case of a customer who is an entrepreneur, the order number, identification of the product, and a description of the objections raised together with the Customer's request related to the complaint.
- Viscar reserves the right to leave complaints that do not meet the conditions specified in sec. 3 without consideration, in particular where the information provided does not allow the Customer to be identified or contacted for the purpose of clarifying the complaint.
- Viscar considers submitted complaints within 14 days from the date of receipt of all information necessary to consider the complaint. In particularly complex cases that make it impossible to consider a complaint within 14 days, Viscar reserves the right to extend the complaint consideration period to 30 days. In such a case, Viscar will inform the customer of the extension of the complaint consideration period before the 14-day period expires, stating the reason for the delay.
- The Customer is required to deliver the complained-about product in its original packaging to the Viscar office at the Customer's own cost and risk.
V. FINAL PROVISIONS
- Viscar reserves the right to amend the Terms and Conditions for important reasons, in particular changes in legal regulations or changes in payment methods - to the extent that such changes affect the implementation of the provisions of these Terms and Conditions. Viscar will inform the customer of each change at least 7 days in advance.
